SALES CONDITIONS
GENERAL
Prices are quoted ex- work and are intended com fabrics and com leather.
Goods are carried at client’s risk. Prices are expressed in Euros,
and do not include VAT (Value Added Tax). Interna Collection reserves the
right to make, without notice, any appropriate improvements to materials,
finishes and product design. Prices are subject to change without notice.
The sending of the price list in no way implies a contractual obligation
on the part of Interna Collection to accept any orders; Interna Collection
reserves the right to accept orders or otherwise, on each separate occasion.
TRANSPORT/FREIGHT
All goods can be collected ex-works. Deliveries can be
made to the recipient, if the customer first requests an offer of transport
costs and he confirms by writing the offer.
PACKAGING
Prices include packaging
in cardboard boxes. If packaging in wooden crates is required, an additional
charge is made: €120 for sofas, €70 for chairs, armchairs, console
tables and large tables, €50 for other tables and occasional tables.
Marble, glass or stone tops are always packed separately in wooden crates.
In such cases, packaging costs are met by Interna Collection.
ORDERS’ EXECUTION
AND INVOICING
Lead times shown on the order confirmation should be regarded
as approximate. When necessary, binding delivery dates can be agreed in advance
and confirmed in writing. Where an order consists of a number of different
items, the customer can require Interna Collection to effectuate either partial
deliveries or one single delivery, with corresponding partial or complete
invoicing. The last consignment made counts as the termination of delivery.
On being notified that the goods ordered are ready for collection or have
been delivered to the agreed destination, the buyer has to effectuate prompt
collection. Variations to an order will be accepted up to three days after
Interna Collection’s issue of an order confirmation. Any changes after
the three-day limit will be considered on an individual basis and will be
subject to a 10% surcharge on the list price for that item. Where the customer
is supplying fabric or other material for upholstered items, the item will
be completed and ready for dispatch/ collection within 20 days of receipt
of said material from the customer. Acceptance of orders which involve the
supply of fabric/material by the customer will be subject to Interna Collection’s
judgment on the suitability of the material chosen for that specific item.
PAYMENT
Terms of payment are as shown on the order confirmation and/or contract.
Late payment will be subject to an increased charge based on the Italian
interest rate applicable at that time.
ORDER CANCELLATION
The cancellation
of an order shall be agreed with Interna Collection, who will reserve the
right to charge the customer for any losses or expenses incurred.
PROPERTY
Interna Collection retains full ownership of the goods until receipt of full
payment
RETURNING GOODS
The return of goods must be agreed in writing with
Interna Collection. The customer is responsible for the correct packaging
of the goods returned and the customer will be liable for any damage caused
by inadequate or incorrect packaging. The cost for returning the goods are
at purchaser charge.
PROBLEMS RELATING TO TRANSPORT/QUALITY
Before accepting
delivery the customer shall check the condition of the packaging and notify
the shippers immediately of any damage or other problems and inform Interna
Collection in writing within 24 hours of delivery. Complaints regarding defects
not resulting from shipping will be considered only if received within 8
days of delivery. Unless a separate written agreement exists, Interna Collection’s
liability is limited to the repair or replacement of an item regarded as
defective by Interna Collection and does not include compensation for any
other expenses incurred.
UPHOLSTERY
All fabrics and sundry material supplied
by the customer must be delivered carriage paid, together with the “Fabric
Form” completed in its entirety (see page 20 of the accompanying price
list). Interna Collection is not responsible for fabrics, leathers and materials
received by the client which do not comply with the fire rating regulation
and standards of commercial use in the country of delivery. The additional
cost for any treatments and certification necessary to respect the above
mentioned regulations and standards are at purchaser’s charge.
WOOD
Owing to the natural qualities of wood, Interna Collection does not guarantee
that items produced using the same type of wood will display uniformity of
colour and grain. Exposure to light and the natural aging process mean that
wood is subject to changes in colour. Interna is not responsible for damages
due to improper use of wooden items
SIZES
The dimensions of all products
stated in the technical specifications are given in centimetres and inches
and are subject to normal tolerances.
WARRANTY
All products carry a 12-months
warranty against correct usage and normal wear and tear. If goods are defective
Interna Collection’s liabilities end when the item being replaced has
been delivered, carriage paid. In order to benefit of a contractual warranty,
the Buyer must advise Interna Collection of any defect on the received furniture
within two weeks of the day on which the defect was noticed.If the defect
is apparent, the claim must be sent to Interna Collection in writing within
8 days of receipt and in any event prior to installation of built-in furniture.
The contractual warranty is strictly limited to the repair or to the replacement
of furniture which have been recognized as defective by an identical or similar
piece of furniture. Under no circumstances can a claim be made for labor,
travel, time, damages, or any compensation or penalty of any kind (namely
for deprivation of use, etc.). The repair, modification or replacement of
parts during the period of warranty does not extend the warranty. The warranty
is conditional upon the customer meeting the payment terms.
JURISDICTION
The contractual agreement implied by the placing of an order by the customer
and the issue of an order confirmation by Interna Collection is governed
by the laws of Italy. Any dispute relating to the execution and interpretation
of the contract/order will be settled exclusively under Italian law and the
exclusive place of jurisdiction is the Udine Law Court.
